Service Tax Applicability

Sir,
In first year, service provider has more than Rs. 10 lak turnover. He gets service tax number and pays service tax on above Rs.10 lak turnover.
In the next year his turnover remains 5 lak.
Again in the third year, his turnover remains 5 lak and he does not hope to have more turnover.
What should he do ?
1. In second year is he supposed to pay service tax?
2. In the third year also is he supposed to pay service tax?
3. Suppose he surrenders his service tax number in the second or in third year, can he get again service tax number when his turnover exceeds taxable limit ? Can he again get threshold limit exemption ?

SERVICE TAX ON RENT

Ours is a Pvt Ltd Co. We had taken office premises on rent. We had stopped payment of Service Tax on Office Rent wef 01.05.2009. Now the landlord has sent letter asking for the Service Tax on Rent @ 10.3% on rent from May,2009, stating that Govt has placed an ammendment in Parliament which further go on to state that no further suit/action would lie in any court in respect of this levy.

Whether we are liable to pay Service Tax to the landlord on the basis of this ammendment in Parliament or shall Delhi High Court judgement striking down the Service Tax on Rent still hold good ?

Service tax on GTA

One of my client which is Registered Society engaged in manufacturing of Bidi , receive the Bidi Patta and pay the frieght charged by tranporter. Is he liable to pay service tax under GTA ? If yes weather the abatement of 75% can be availed by him ? I am confused that as the service receiver is paying the frieght, 75 % abatement will not be allowed. Please guide

Exchange rate

Dear,

I would like to know about exchange rate to be applied for conversion for payment of service tax. whether i should apply exchange rate available at the time of booking of invoice or exchange rate available at the time of payment to service provider.

Rent

Dear Sir, Please consider the example:
A Private hospital earning income from their in-patient, such charging room rent and other treatment charges.
Room rent is charged to patient with out service tax. Since, hospital turnover was Rs. 1.5 crores per month.
Query:
1. Whether the hospital is liable to Service tax?
2. If yes or no, Please explain

hi,
Please clear the position in case of service tax applicablity of rail freight in case of exporter. A company being exporter, paying rail freight. Railway is charging service tax. Now whether service tax is applicable on railway freight. Exporter is rice exporter. Whether any exemption is available to rice exporter in the category of food grain

service tax retrun

This qtr(Apri-June10) i have no raised any service. It is mandatory for filling zero retunrn or not. pls suggest me.

Service Tax - Plz help on this

Dear sir,

If company A is take over by company B which is MNC. After this, raised for a new invoice in the name of B company and in invoice mention old co. service tax reg. no.?
When we raised the bill we mention that ( Formerly A Co. ) below the name of A Co.


It is legally true?

Hire Charges

Sir/Madam

If any company gives bykes on rent and give the term as Hire Charges whether it will still come under service tax? And whether MVAT will be applicable on it. Please give the answer in detail. So that I can understand the implication of the word HIRE on service tax & VAT.
