12 August 2010 I am not registered with excise.but registered with service tax.I have allowed to use my brand name to client and this is
covered under sales tax definition .Hence
sales tax authorities asked me to pay the
sales tax.Accordingly I have paid sales
tax and recovered from the client.Now service tax Authorities are asking me that
this is covered under intellectual Property and to pay the service tax.
Whether I am liable to pay service tax or sales tax .please guide me.please also
provide related provisions.

15 August 2010 If the VAT of rspective state is levied on Brand usage then ofcourse the same is payable.

As far as service tax is concerned, it gets attracted under Intelectual Prperty heading.
