17 November 2012 One of our clients had received an order u/s 154 from the assessing officer related to F.Y. 2004-05 now demanding a tax. The assessee wants to appeal against the said order but the problem is that the period of 30 days has expired. Can he still file an appeal before commissioner (appeals) and would it be entertained by the commissioner (appeals)? Please suggest. Its urgent.

17 November 2012 A condonation petition,for the delay, has also to be filed along with the appeal. Generally,delay will be condoned by CIT(A) and appeal will admitted.
