Amendment of trust deed - is approval of commissioner reqd?

15 March 2012 Dear Expert,

Ours is a public charitable trust having and carrying on with religious and charitable objectives. We were planning to execute certain amendments on the administrative portion of the Trust deed i.e., we are not changing any thing of the objects clause.

In the trust deed the clause on amendments indicates as follows ".... Further no amendments shall be carried out without the prior approval of the commissioner of income tax as required by the law or getting exemption under the Income Tax act, 1961"

So we are not clear whether to go for approval of commissioner of Income Tax as the amendment is no way effecting the objects of the trust.

We request the learned experts to advise and help us serve the society better.
