Please see my basic query :

Query

From the recent amendment in Form 8, effective 29.05.11, is it that three signatories to be signed i.e.

1. On behalf of Company (Dir / MD / WTCS).
2. On behalf of Charge holder.
3. Certification by a professional (CA/CS/ICWA).

With the certification by a professional only, the Form 8 can be uploaded with immediate effect.

Also, as the form is certified by a professional, it is treated as Straight Through Process.

I have not tried in new form. However my under standing is, borrower and lender has to be digitally sign the form. This is a mandatory requirement. Consequence is ROC's approval is required to take the form into MCA records.
Professional's digital signature is optional. If signed along with borrower and lender, most of the documents (wordings in Circular 14/2011 dated 8/4/2011) will be accepted by MCA system with out the approval by ROC or MCA officials.
