13 June 2015 WHETHER THE GOODS CARRIAGE VEHICLE TAKEN ON LEASE FOR FURTHER PROVIDING THE SAME FOR LEASING/PLYING WILL BE COUNTED AS A VEHICLE UNDER SECTION 44AE CONSIDERING THE LIMIT OF 10 VEHICLES?

13 June 2015 44AE is a presumptive section.

It is meant for SMALL operators.

the word SMALL is very very important....

If the transport operator is not a small one......let us not advocate him to go for 44AE, that is what my contention is.

Now as per the litraligis of sec 44AE, the person has to own not more than 10 vehicles...(Leasing is NOT owning)
