194j vs 194c

03 July 2013 Please tell me the difference between these.

If paid for Clearing & Forwarding.. need to deduct U/s 194J or 194C.

What if we deduct in different sections?

03 July 2013 For clearing and Forwarding Section 194C will be applicable. It does not fall under any professional or technical service so section 194J can not be applied.

03 July 2013 194C is applicable and not 194J

Circular : No. 715, dated 8-8-1995.

Payments made to clearing and forwarding agents are subjected to deduction of tax at source under section 194C

04 July 2013 If Suppose i deduct TDS under 194J @ 10%.
Is there any problem if i do so?

04 July 2013 No problem provided the deductee dont protest. You can still file the return showing as deduction u/s 194J. Deductee will also get the credit of the TDS amount. No issues with that.
