One of my client owns 9 trucks and also hire 5 trucks on commission basis from another transport company .can he give 194C declaration for non deduction of TDS???

yes as long as he doesn't own more than ten trucks since the words used are 'own' and therefore any truck hired by him on commission basis which he doesn't actually own shall not be counted.

yes, truck in his owner ship is less than 10 truck.

Cannot give declaration since 'who owns' should be understood as 'who possesses'. Inference - explanation (b) to section 44AE.
