14 October 2011 we are refinery industries in gujarat, we order to a party of rajasthan to sale chemical for refining process they billed agst form c 2% ,but material is delivered from gujarat to gujarat from third party
excise invoice send by third party this invoice in vat 5% can we issue form c to party of rajasthan.

14 October 2011 Yes you have to issue form C.
For you what is applicable is Excise amount as mentioned in third party incoice (you are in no way concerned if third party invoice has charged vat or cst)
For Vat/CST refer the invoice of your actual vendor.
