What can be done if a company's status is strike off in mca

20 November 2010 Sir,
One company incorporated in the year 1999. They didn't file any subsequent forms with MCA. In the portal's company's master data page the companies status is "Strike off". What will be the actions from our side to continue or winding-up?

21 November 2010 If decided to continue, move a petition before the Jurisdictional High Court under section 560(6) of the Companies Act,1956 to reinstate the name in the register maintained by the Registrar of Companies. If not nothing is to be done.

21 November 2010 What will be the consequences if nothing is to be done? If any suit to be faced by the directors...etc?

21 November 2010 Dear Friend

First check whether petition file in HC, If petition was not filed with HC then simply draft letter to the ROC for filling of Annual return.

If petition is filed with HC then HC may give order to clear debt & then srikeoff the name, normaly there is no director liability or any action director. Normaly the ROC issue notice in new paper for stike off name.
