I have consider trading in shares as capital gain.
Whether there is any case laws which support this treatment. Plz give reply as soon as possible.

If your business is dealing in shares means it is taxable under the head Profits & Gains from Business or Profession if not then taxable under the head Capital Gain

In otherwords, you have a choice. But once you havwe chosen an option you have to live with that.

Dealing in shares without actual delivery of the same is speculation business u/s 43(5) of the act.
