06 August 2014 I received my company's VCES rejection order on 16-05-2014, passed by Jurisdictional Assistant Commissioner.
In terms of Sec. 85 of the act, the appeal can be preferred to Commissioner (Appeals)within 3 months from the date of receipt of order.
In this case the said date comes to 15-08-2014 (Independence day holiday), 16-08-2014 & 17-08-2014 being Saturday & Sunday, can I file my appeal on 18-08-2014?
Whether department can initiate any action before 15-08-2014 for enforcing the recovery arising due to rejection of VCES?

06 August 2014 As per general clause act, if the last day is public holiday, the same can be filled in the next day which is not public holiday.

Why don't you file the same on 14th to place the dispute to rest ?

I agree with you that to avoid any dispute, I should file the same on 14th, but my concern is that if for any reason whatsoever, I am not able to file the same on 14th; can the department initiate recovery proceedings on 14th or 18th?
