Urgent -payment to non resident

Dear Sir,
One of my client has paid an amount of Rs.880,375/-( US$12500) to CRM, Belgium for using Tempcore's trademark for its TMT products in AY 2013-14.
For your information the payee has not furnished its PAN..and it has no Permanent Establishment in India..
Pls advise the implication of TDS and service tax and what about the rate & DTAA rate??

Kindly deduct TDS @ 25% + 3% ed. & she cess.
