09 August 2015 Respected members I need your help very urgent.I have completed 2 years of article ship but due to certain personal family issues i cant continue my article ship.I want to take termination so i could continue it in future.My principal is also ready to give me termination.So my query is that what reason do i have to give to institute or can i take termination by mutual consent.What procedure i have to follow.And after how much time i can continue my article ship again.

09 August 2015 thanks for prompt reply sir.but i have completed 2 years of articleship .so i wanted to ask can i still take termination on basis of mutual consent.cause actually becuseof ill health of my mother i cant continue articleship currently.please can you tell what i need to do .and thanks again sir.

09 August 2015 thanks for reply Amol sir.can u clear one more doubt.For do i have to send medical certificate of my mother to institute.and firstly i need to send a application to institute stating my problem sealed and approved by my pricipal.and then have to fill form 109 after getting approval of institute .plz tell if im right.and thanks a lot for ur help.

10 August 2015 ANNOUNCEMENT

Transfer/Termination of Articleship
[Regulation 56(1)]

As informed earlier vide announcement dated 2nd July 2010, ICAI is allowing the articled assistants to seek transfer/termination of articleship only on permissible grounds and the articled assistants are advised to get the consent of the Institute before getting Form 109 signed by the Principal in their own interest.

However, it is noticed that some of the articled assistants are submitting Form 109 signed by the principal along with the application for transfer/termination of articleship. Issuance of Form 109 prior to formal approval of the Institute for transfer will not be taken into record.

It is advised that Principal and articled assistant may forward Form 109 duly signed by both of them only after obtaining the prior permission of the Institute for transfer/termination.
