24 June 2015 We are seeking advise for possibility of Transferring foreign company's branch office employees to Indian Private Limited company under agreement with all liabilities under mutual understanding.Indian company is also promoted by them and both company's management are same.

Please have your opinion.

24 June 2015 you have to deduct the tds as salary if they are doing work on the salary basis as per agreement. or deduct tds u/s 194J

24 June 2015 If within service conditions of the employees then simply issue transfer orders and if no such condition to transfer within the group companies exist then insert this condition by notifying specifically and obtain the acceptance of the relevant employees then execute your orders.
