TDS WITHOUT AGREEMENT/WORK ORDER

I have hired a catering service for my office but have not entered into any formal agreement with him .his bill for last month is 42000 , do i need to deduct tds as we have not enter into any agreement legally.

But generally it is nature of contract. So you have to deduct TDS@1% (if Ind,HUF) or 2% (other) u/s 194C
