Case Background :

In F.Y 2010-11, there was a Company that revised its TDS Return because of which already paid TDS remained Unutilised. Company has not yet Claimed the benefit of TDS already paid to the govt but wishes to Claim it in the Current Year.

Is the Company eligible for Claiming the Unutilised TDS amount? If yes, What are the remedial measures that can be taken by the Company? There is a new option of “Request for Refund” available on TRACES site but it has not been activated yet. Kindly respond with proper reasoning supporting the Answer. Thanks & Regards.

Answer to your Query is "Yes"
Assessee has to prove that he/ she paid excess and burden not passed to deductee.
Preferable to contact TDS department by intimating excess payment of TDS through letter and payment challans.
They activate your "Request for refund " in TRACE to claim refund .
