12 July 2013 We appoint a cargo company for our import clearance we pay them the amount of custom duty and stamp duty and then they pay custom duty and stamp duty on behalf of us my question is we are liable for to Deduct TDS u/s 194 C on the amount which we paid to Cargo company which is purely custom duty and stamp duty?

please give me a suggestion.

12 July 2013 The cargo agency must be getting some fees for their services Apart from the reimbursement of Custom Duty and Stamp Duty?

13 July 2013 No fees paid by us to Cargo company apart from Custom & Stamp Duty, The fees is paid by third party on behalf of us.

13 July 2013 Then you are not required to deduct TDS. Section 194C will not be attracted.

14 July 2013 If 3rd party pays on ur behalf then sec 194C doesnt get attracted.
