19 November 2012 dear all,
my uncle is having a travelling business and some companies deduct tax at source. in previous year 2009-10 total deduction was rs 16785.but he didn't file his return and not claim refund.he is not liable to pay tax b'coz coming under basic exemption limit. please suggest me is there any solution for claiming refund for previous year 2009-10 a.y.2010-11

19 November 2012 The last date for filing the return was 31/03/2012. So now you cannot file the return. But other people may have a different opinion.

19 November 2012 Hi,

Last dae for filing return for FY 2009-10 was 31.03.11 & Fy 2010-11 was 31.03.12. So you can not file return belatedly.

However you can file return online & try your luck.

19 November 2012 @VaibhavJ : The last date is 1 year from the end of assessment year. So in my opinion the last date was 31.03.2012 for AY 2010-11.

That is the reason why we are still able to file returns for both AY 2011-12 and AY 2012-13

19 November 2012 Yes you can try definately.

FY 2009-10 = AY 2010-11 & Due date will be 31.3.2012

& Similarly FY 2010-11 = AY 2011-12 & Due date will be 31.3.2013.

Since due date for AY 2010-11 is already passed away we can not file return technically.

19 November 2012 is there any penalty provision if i file return of AY 2010-11 after 31.03.2012

20 November 2012 First of all you cannot file return for AY 2010-11 now as the time limit for filing the same has expired.

You can file the return only if the assessing officer issues a notice u/s 142(1).
