Tds on transporter invoice

Dear Sir
One of our transporter is having 2 owned vehicles and 10 rented vehicles.
Total vehicles he is having is more than 10.
Now our question is whether we should deduct tds on his invoice ?
Or declaration should be taken from him that he is having less than 10 owned vehicles.
and not to deduct TDS ?
He is overall having more than 12 vehicles - whether tds applicable ?

u/s 194C if he not owned 10 vehicle. means its in his ownership.
if he take on rented then not consider for that.
if he take on rented then not consider for that.
