Yes, TDS borne by the payer will be disallowed. Please check the Mumbai Tribunal case in RMC Readymix India Pvt. Ltd. vs. DCIT, Central Circle 34, Mumbai - ITA No.1255/Mum/08 A.Y.2004-05 : Date of pronouncement 07.01.2011 ( Unreported Order ). You can get the order copy from www.itat.nic.in
