i want to know, if the tds not deposited by the party and not showing in form 26as therefor can we claim tds in income tax or not
please reply...

16 May 2014 If it is not showing in 26AS but in 16 or 16A then u can claim it. But in ur case as if it not deposited yet then u cant claim it. Coz it will contradict with the statement.

if the deductor has not deposited and file tds return then it will not going to reflect in 26as. but you can file you income tax return with deductor tan and deduction details.

you should have to ask you deductor to file tds return or if they are going to do then wait for somedays.

16 May 2014 U Must ask the deductor that if u will not the TDS deduction till he/she deposit the tax. So tell the party to do ASAP.
