if a person deducted tds but not paid to govt. due to fund problem . whether he can issue tds certificate without making payment or pls. tell me under which sec. it is mentioned that tds certificate can be issued after making payment.

No ,impossible , you have to deposit otherwise TDS certificate will be fake and may lead penal action
