16 July 2009 Dear All,

If the employer does not provide the TDS Certificate(Form 16) to its ex-employee, inspite of reminders by the ex-employee, then how that person(ex-employee) will proceed to file his income tax return?

16 July 2009 If employer deduct the TDS of salaried employee, thn it is the duty of employer that he have to provide the Form16 to employee, but in case, employer not to do so thn in case employee cannot filed his ITR.

16 July 2009 You will b happy to know that for filing return you do not need Form 16 as the return has been made annexure less .Therefore, as far as filing of return is concerned, just fill up form ITR1 or ITR 2 and claim whatever tax is deducted form you .

16 July 2009 Yes, I agree with expert, but the information of form 16 is required to file the return.
You can follow the following way to get the form 16,

01. Send a letter to your employer for issuance of form 16
02. In case of no reply, then send reminder letter
03. If still no reply then send letter to employer under CC to 1) TDS officer of income tax department 2) your concern ITO
