TDS on services rendered by inspection agency abroad at customers premises in UK i e inspection of goods dispatched from india . Inspection agency is not having PE in india.

UNDER SEC. 195 h, FEES FOR TECH. SERVICES PAYABLE BY GOVT. OR AN INDIAN CONCERN IN PURSUANCE OF AN AGREEMENT MADE BY NON RESIDENT WITH THE GOVT. OR THE INDIAN CONCERN AND THE AGREEMENT IS APPROVED BY CENTRAL GOVT.OR WHERE IT RELATES TO MATTER INCLUDED IN IND. POLICY,THE AGREEMENT IS IN ACCORDANCE WITH THAT POLICY,
- where the agreement is made on or after 01-06-2005-TDS IS applicable @10%plus sc 0.25 and ec 0.205 -total of 10.455%.
IF THE AGREEMENT IS MADE AFTER MAY 97 BUT BEFORE 01-06-2005 ,THE RATES OF TDS ARE DOUBLE OF WHAT IS GIVEN ABOVE.

UNDER CLAUSE Vii of subsection 1 of sec. 9
TDS IS ATTRACTED SINCE THE EXCEPTION STATED IN SUBCLAUSE b of clause vii does not apply in your case.
