i) Is tds deductible on payments made to amazon web services USA for cloud computing services.


19 August 2014 it should be conver u./s 195 tds will be deductd @ 10% if have PAN other wise
@ 20%.

But can you please clarify whether cloud service will fall under royalty or fees for technical service ? Since amazon web service is non resident in India and in case of non resident following services are taxable in India if it has not permanent establishment in Inida :
i) Interest
ii) Royalty
iii) Fees for technical services.

* **Fees for Technical Services (FTS)** (Section 9(1)(vii)) relates to payment for managerial, technical, or consultancy services.
