26 July 2013 my client purchased timber from up forest corporation. up forest corporation collect tax (TCS) from my client.but the said TCS is not shown in Form 26AS. and up forest did not issue any form 27D. now problem is that how we claim TCS without form 27D.

client have proper authenticated tax invoice issued by up forest corporation in which amount of tcs is properly shown.

can we claim TCS on the basis of above tax invoice.or is there any other way to claim refund of TCS.

26 July 2013 If 26AS not showing TCS Credited then you can not do claim of tcs in this case. For betterment of yours send a request letter to UP forest corporation for uploading the TCS Return. If they will filing return then and then only you will be eligible for such TCS Claim.

29 July 2013 is depratment has the right to deny the balance claim shown in the 26as on the ground that some of the tds claimed in the itr is not showing in 26as
