a foreign company appoint a agent in india & for selling his product & agent get 10% commission on sale.if agent raised a commission bill with service tax.it is the duty of agent to pay service tax.

Service provider is in India and service provided is witnin India. Since the agent is the service provider, he is liable to service tax.
