I have tds in FY 09-10 & 10-11, but income is below taxable. Can today i file return for tds refund. Whethere there is any penalty or fine. Please suggest.

Dear Ravindra you can not file return for the F.Y you have mentioned in your query as the due date for filling the return for the said A.Y releavant to F.Y you have mentioned has been expired

Please file a petition to the Commissioner of Income tax seeking to give direction to the ITO to accept the return and issue refund.
