23 July 2014 if an assessee is resident in India and received salary for 8 month in India n for rest month he went to USA for employent and recd 3 month salary there.what will the tax implication in such case?? n if salary is paid in usa after deduction of tds then hw assessee will able to take the refund. please guide.

23 July 2014 in such case he is non resident for prev 13-14 so only indian income is taxable....file itr-1 for refund.

26 July 2014 wondering how staying in US for four months make anyone non-resident.

please note that the person shall be resident for the said financial year. all of his income shall be taxable in India. you shall have to file ITR-2 to claim credit for the taxes paid in US. any excess tax credit above the tax liability shall be claimed as refund

28 July 2014 Dear Anuj,

You need to do as follows:

1. you need to report the whole of the income earned (in India and in US) in ITR 2 "PartB - TI-TTI-SAL" sheet

2. claim credit for the taxes deducted in US in "FSI" sheet.
