If a company proposes to purchase optionlly/compulsory convertible prefernce shares of a listed entity then will takeover code be trigred ?

Ya if the holding of convertiable instrument is under creeping limit....

But the defination of the shares specially excludes preference shares ?
So how to interprete that defination provided in SEBI (SAST) Regulation 1997 ?
