Summon u/s 131

26 September 2012 Dear Sir,

Whether summon u/s 131 is issued in normal cases or not issued generally, instead 143(2),143(3) is issued??

And if any assessee gets summon u/s 131 for attendance and production of books of account then how should he proceed further for saving himself from burden of tax on income and penalty as well.

kindly suggest how can he convince the commissioner with the income shown in ITR.

26 September 2012 Yes. The genuinity can always be proved beyond doubts. 131 is normally made use of when return is not on the record of the department or department has some clue about the assessee's income.

26 September 2012 In simple words notice u/s 131 is served when IT dept has reason to believe the assessee has some disguised income which he has not disclosed and it is believed this is 1st step towards Income Tax Raid.
