Subcontracting (job work) and repair of equipment for sez

This query is : Resolved

05 July 2013 I need clarification on following points related to SEZ
1. What documents are required for Subcontracting of materials outside the SEZ Premises.

2. If the materials do not return within 180 days, then will any tax / duty be applicable.

3. When some equipment will be sent outside the SEZ for repair purpose, then what documents will be required.

05 July 2013 Goods will be removed on chalan from outside the factory. If goods will not be return within 180 days duty will be payable on that goods.

05 July 2013 Hi Arun,
Which Challan is required. Simple delivery challan or 57 F2 Challan.

Being in SEZ they don't have Excise registration, then how excise duty will be payable.

26 July 2025 Here's a clear and concise explanation on your SEZ-related subcontracting and repair queries:

---

### 1. **Documents required for subcontracting of materials outside SEZ premises:**

* **Delivery Challan:**
When goods/materials are sent outside the SEZ for job work/subcontracting, they should be sent under a **Delivery Challan** (sometimes called a job work challan). This document describes the quantity, description, and details of goods sent.

* **Declaration by SEZ unit:**
SEZ units typically issue a declaration on the challan stating that the goods are being sent for job work and will be returned within the stipulated time (usually 180 days).

* **Bond or Undertaking:**
Sometimes, a bond or undertaking is taken from the subcontractor that goods will be returned in stipulated time or duty will be paid.

* **Invoice (if applicable):**
If subcontractor raises any invoice, it should comply with SEZ regulations.

---

### 2. **If the materials do not return within 180 days, will any tax/duty be applicable?**

* **Yes.**
As per Central Excise/Customs (whichever applicable) and SEZ rules, if goods sent outside the SEZ unit or developer do **not return within 180 days**, then **applicable customs/excise duty and other taxes** become payable on those goods as if they were cleared to the domestic tariff area.

* This is a safeguard to prevent misuse of SEZ benefits.

---

### 3. **Documents required when equipment is sent outside SEZ for repair:**

* **Delivery Challan:**
As above, a delivery challan specifying the equipment sent for repair.

* **Repair Agreement / Contract:**
If applicable, a contract or repair order with the service provider outside SEZ.

* **Declaration / Undertaking:**
Declaration stating the equipment is sent for repair and will be returned.

* **Return Challan / Receipt:**
When equipment is returned, a proper receipt or challan should be maintained.

---

### Additional Notes:

* **Challan Type:**
Usually, a **regular delivery challan** suffices for SEZ units since they are exempt from excise registration (they operate under different customs/excise regimes). A **Form 57F2 challan** is generally used in domestic excise contexts.

* **Duty Payment:**
SEZ units are generally exempt from excise/customs duties on goods brought into SEZ for authorized operations. However, if goods go outside SEZ for job work and do not return within 180 days, duty liability arises.

If you want, I can provide a sample delivery challan format or a checklist for documentation. Would you like that?
