10 October 2014 Company incorporated in Nov,13, not filed its statutory meeting report with ROC. Can it be filed now as late report if yes den in which form?

10 October 2014 No form is available now to file statutory report. Though section 165 is not revoked by MCA.

This is a good example of style of working of MCA. The question here is very simple. Whether Sec.165 of CA 1956 is in force today or not? MCA in its general circular No.7 of 1.4.2014 has only given chart showing sections of CA 1956 corresponding to notified sections of CA 2013 which are not in force now. Naturally, it does not include Sec.165 since there is no corresponding Sec. in CA 2013. So technically speaking, this section is still in force. However, we all know that this is not the intention of the law and MCA will also not make any provision in its website for filing of statutory report any more. Hence practical answer is: If you have not held statutory meeting till 31.3.2014, just forget it.
