One of our clients a Partnership firm was allotted a PAN about ten years back which indicates the status of an Association of Persons. All these years (including the last year of online filing)we have been filing the IT Returns indicating the status as "FIRM". When we tried to file the ITR and Form 3CD we were denied access in the site stating that there is mismatch between the Status mentioned in the form and the PAN (which indicates an AOP). There is no option to change the status in the PAN and hence we seek a way out of the situation. Pl enlighten Sivasailam D

if the status has been changed in reality from AOP to firm then first u need to submit the aop pan and get new pan in name of firm then only id dept will accept it.

Mr Tushar, It is not actually change of status initiated by the entity. Department, while issuing PAN in the beginning in response to the application by the Firm, had mistakenly treated it as AoP and had been accepting the returns so far, without a whimper or caution to the assesse about this mix up.
In this back drop can the assessee ask for the change in PAN or apply for a fresh PAN.
What will happen to the TDS, Refund or Advance Tax already paid in the existing PAN ?

in such case you need to meet AO as you said its dept mistake then they will rectify it and your rights as as assessee available will not be affected.
