Say, X is a Pvt Ltd Co,In this company one of its shareholders tranfer his share to the other doing all the formalities required in ROC.Now the question is the tranfer was made in the month of September 2009 and the share transfer deed is of April2009.Is he right in doing that??? Do reply...
The Date of Logdement of tranfer is 15th sept2009 and date of tranfer is 30th Sept2009???then

In case of private Company transfer deed need to be executed within 2 months from the date of presentation to ROC.
Hence if transfer deed is of april 09 than need to be presented to Company by Jun'09.
Hence it is not vaild transfer.
If possible change the date of transfer or execute other transfer deed between Jul 09 to Sep 09 (max 2months gap)
