Is it necessary to collect service tax in case of voluntary registration, if the exemption limit of 10 lakhs is not met.

No need to collect service tax till you receipts exceed Rs. 10,00,000/- even if you have voluntarily registered.
However return filing compulsory if registered even voluntarily.

Since the availment of SSI exemption is optional, you shall informm the department by way of a letter, or make a note to that effect in the return, if filed manually.

You should write Notification No. 08/2008 dated 01/03/2008 in column C2 of the service tax return for claiming benefit of exemption of Rs. 10 lakhs. There is no need to informm the department by way of a letter.

The department is asking for collection of service tax on bills already raised and also to collect tax on subsequent bills though the turnover of my client is only Rs.2 lakhs so far.

The relevant notification is 6/2005-Service Tax dated, 01/03/2005, as ammended by the notification referred to by Mr. Aditya Maheswari.

Collection of service tax on bills already raised and also to collect tax on subsequent bills though the turnover of ur client is only Rs. 2 lakhs so far can only be made if the turnover last year exceeded Rs. 10 lakhs. If not then it the action of the department is wrong.
