14 June 2009 Sir, I wish to know that service tax is applicable on building works contract in govt affliated educational institutes such as IIT,IIM, IIIT

14 June 2009 Work contract for construction of buildings or civil structure in full or part of them which are primarily used in commerce and industry is taxable to service tax.

In case of works contract for construction of IIT,IIM,IIIT building, which are definitely not used primarily for commerce or industry, and should not attract service tax.
