SERVICE TAX ON WORK CONTRACTS

29 June 2007 Govt says that New Circular issued superseeding all old circulars.Now this circular issued but still there are many question unsolved even in this circular for which this querry.

Now I want clearifications on following and all are related with service tax on work contract.

1. WHAT POSITION STANDS FOR SERVICE TAX ON M.E.S AND RESERVE BANK.THERE WAS OLD CIRCULARS THAT THESE BOTH DEPARTMENTS ARE EXEMPTED FROM SERVICE TAX BUT NOTHING SAID IN ALLEGED LATEST.

2.AT ONE PLACE CIRCULAR SAYS THAT THERE IS NO S.T ON GOVT WORKS.WHAT IS POSITION NOW.

MES and RBI have not excluded. No exclusion has been given for Govt related works contract. But please note that only commercial/industrial WC or resi complexes are covered by WC Service tax.

In short, it is not the person who is exempted, but it is the specific nature of service.

07 August 2007 YOUR INFORMATIONS ARE NOT CORRECT.CIRCULARS ARE THERE WHEHE GOVT SPECIALLY HAS SAID THAT RBI IS EXEMPTED.FOR MES IT IS DOING ONLY DEFANCE WORKS AND NOT COMMERCIAL HENCE EXEMPTED BUT IN PRESENT SCENERIOS NOTHING GIVEN.
