Service tax on transport

15 May 2010 We are in indrastructure business (roads, damss, etc). We take material from third parties and transport them to our sites.

Whether service tax would be applicable on transportion charges we pay to transporters.

15 May 2010 Yes, Service tax applicable on it.

If transporter has not charged, the liablity of service Receiver i.e you have to deposit service tax.

17 May 2010 Yes agreed with sri Bansal.You may claim the 75% abatement which has been allowed under Nfn.No.32/2004 ST dated 03.12.2004. Calculate and pay S.Tax on the balance 25% @10.30%.

21 May 2010 i have query..
whether same rule would be applicable if turnover of transporter is less then Rs 10 lakhs?
what happen if infrastructure business has its own transport whom turnover is less then required amount of Rs 10 lakhs

Threshold exemption limit is allowed.

So service tax rule will not applicable in your case.
