there is a judgement to this effect but law is no amended yet. you can take either of stand.

It has been termed as unconstitutional by Delhi High Court vide their Judgement on 18th April 2009, & therefore any unconstitutional law becomes scrapped with immd effect of the date of judgement & till date the Cent. Govt has not preferred any appeal in the supreme court agst the order of the high court
