04 March 2010 As per finance Bill 2010, Service tax on rent of immovable property as been introduced retrospectivly.

Pl advise, whether service tax is to be deposited with department for prior period along with interest on service tax or without interest?

04 March 2010 As per Finance Bill 2010, the effect will come from the date of notification i.e., after bill becoming an act.
If the above change is approved in the same spirit, then liability along with interest will be required to be paid with effect from 01.06.2007.
In case this becomes an act, it has the effect of nullyfying the Delhi High Court Order for stay of paying ST on Renting of House Property.

04 March 2010 Thanks for your reply...one more thing i wish to ask

Should we pay service tax on rent under protest as there could be any further judgement by apex court in favour of assessee or stay on service tax on rent...then we would be able to get refund from the department..
