Service tax on rent of Commercial Property

20 December 2010 We are receiving a rent from ICICI bank on Commercial property but the bank is not paying to us the Service tax amount on the rental amount.
Are we liable to pay the service tax amount, even the bank does not pay to us & if yes then shall we calculate it on prorata basis assuming that the rent recd. included the service tax amount.
