17 December 2013 Two bothers have inherited property from their mother, so it's not a wilful association. The total rent is 16 lacs p.a. - 8 lacs for each brother p.a. Is the Service Tax applicable in this case?

17 December 2013 doesn't matter services provided willfully or accidentally.

18 December 2013 Since each brother is getting 8 lacs rent per annum, both can claim threshold exemption of Rs.10 lacs, as both of them are service providers jointly. Hence service tax is not applicable.
