12 November 2008 A Company;'s invoice having terms as free delivery and the unit price includes freight amount too. In this case, whether company has to pay service tax on freight paid?

13 November 2008 1)If the transporter has not paid the service tax, in that case whether service has to be paid by the company or not, even if freight was included in the unit price of the customer?.

2)In certain cases the GTA himself discharges the ST though the liability is on the specified person. In this case whether there is a need for the specified person to pay the service tax?

13 November 2008 1)The point is whose responsibility it is to engage the carrier? Supposing it is that of supplier, which is the case of CIF contracts, the transporter's bill will be on supplier and he has to pay.
2)There is no need to pay Servicetax twice on the same service.
