Service Tax on commerical rent

24 July 2009 there is no service tax for commerical rent.. any one please expain with case laws ... recently i saw one case law regardig this in the mumbai highcourt case....... it is applicable to south india also ......... thanks in advance for replying this mail.........

24 July 2009 THE RECENT ORDER OF DELHI HIGH COURT HAS STRUCK DOWN THE LEVY OF SERVICE TAX ON RENTING.

GOVT. HAS FILED APPEAL AGAINST THIS DECISION IN SUPREME COURT ON 2ND JUNE 09 WHICH HAS BEEN ADMITTED BUT THERE IS NO STAY.

THEREFORE AS OF NOW THERE IS NO NEED TO PAY SERVICE TAX ON RENT.

DELHI HIGH COURT WAS ASKED TO HEAR THIS CASE BY THE SUPREME COURT OF INDIA ON THE REQUEST OF GOVT. OF INDIA TO TRANSFER ALL THE CASES IN DIFFERENT HIGH COURTS TO DELHI.HENCE THE ORDER OF DELHI HIGH COURT IS APPLICABLE TO ALL OVER INDIA EXCEPT J & K
