01 December 2010 Dear Experts,

Service tax input is not taken from last 6 month under ER-1 monthly returns,My query is shall i take that credit now or what is the procedure,

pls clarify

06 December 2010 There is no time limit for taking credit. You can take credit in the current month, in the same way you are taking credit on current invoice.
The issue has been settled in Johnson Matthey [2009 (240) ELT 673], Coromandal Fertilisers [2009 (239) ELT 99]. P&H High Court has approved the view in Industrial Cables [2009 (236) ELT 658].
