service tax exemption for merchant exporter

28 January 2009 Dear Experts. One of my clients is merchant exporter. He is charged with service tax for ocean freight and clearing & forwarding charget etc. whether he can get refund of the same? whether he can ask the service provider not to charge service tax? Pls clarify.Thanks in advance.

You cannot insist on the service provider not to charge service tax.

However you can get refund from the service tax department on production of necesary proof of documents that you have utilised these services for the purpose of export.
