16 April 2009 If service Tax on Freight is paid by Consignor not by consignee then is any declaration form is necessary to take by consignor that he has paid Service Tax. If Yes then please send me this declaration form.

16 April 2009 The interpretation is incorrect. Declaration is required from the GTA and not the consignor or consignee.

Even if consignor has paid service tax, then consignor needs to seek declaration from the Transporter.

It is a matter of securing your interest that Consignor has paid, is not a part of the provision of the act.

There is no specified format, only a declartion stating that Service tax on the said consignment note has been paid is sufficient

16 April 2009 From 01.03.2008,the requirement for declaration in respect of non-availment of CENVAT credit by the GTA has been done away with.
