Can we avail credit of input service tax for the custom duties paid on export and import.?

04 October 2012 Custom duty is different thing..and we dont have to pay any duty when we are exporting goods...bcz in many notifications it is exempt, but yes if we are importing goods and we have paid some service tax for unloading or unloading, then we can claim that cenvat.

05 October 2012 Although export duty is exempt on most of the articles.but still export duty is levied on certain articles like leather articles, transfermor oil etc. And for your query.....yes .... We can take credit of custom duty paid under the service tax. But such credit will be allowed for CVD3(1) AND CVD3(3) only.And for CVD3(5) refund can be claimed.
